Your working life · 9 steps
A dismissal or the end of a fixed-term contract is not the time to sign everything quickly: it's the time to check every amount, collect your documents, keep your health cover and register with France Travail without waiting. And, if the reason or the procedure doesn't hold up, to know that the deadline to challenge it is already running. Here is the order, with the page that handles each step.
A letter inviting you to a preliminary meeting, a meeting where you can bring someone to assist you, then a letter stating the reason. Keep the letter, the envelope and the acknowledgement of receipt: the date of notification starts your deadlines. Within the 15 days that follow, you can ask your employer in writing to clarify the reason.
Without a permanent job with the same employer, the end-of-contract bonus is added to your last salary; turning down a permanent job for the same or a similar position, paid at least as much, loses it: reply in writing. If your employer ends your probation, they must give notice, or else owe you compensation.
Redundancy payment (or your collective agreement's, if it's more favourable), notice, untaken leave, bonuses provided for in your contract: work out each amount before the contract ends, so you can then check your final pay statement line by line.
The documents are to be collected at the company at the end of the notice period, even if you didn't work it. You don't have to sign the final pay statement; once signed, the amounts on it can only be challenged within 6 months. Check the reason for termination on the France Travail certificate: it's what counts for your benefits.
Missing salary, overtime or bonus, even after the contract has ended: a claim letter with a precise deadline, then the employment tribunal if nothing happens. You have 3 years from the date the money should have been paid, 6 months if it appears on a final statement you signed.
From the day after your contract ends, notice included, without waiting for your employer's certificate: registration doubles as your benefit claim, and benefit never starts before your registration date. Simulate the amount, the duration and the date of the first payment.
Portability follows your unemployment benefit: as soon as your rights are open, download the certificate from your France Travail account and send it to your former health insurer. It's up to you to prove you're receiving benefit.
A questionable reason or a procedure not followed: you have 12 months from notification to go to the employment tribunal (conseil de prud'hommes). A union advocate can assist you for free, and a lawyer isn't required. Nego cites the rule and its source, and tells you when you need individual advice.
Your CPF stays with you, whatever the reason your contract ended; an up-to-date CV and your market value prepare your next negotiation. What follows for unemployment is in the “I'm out of work” guide.
Describe your situation: Nego tells you where to start, follows the checked steps of each procedure, does the calculations with the site's tools and drafts your letters. It does not replace the administration: each procedure is completed on the official service.
Unless it's for serious or gross misconduct, the statutory redundancy payment if you have the required length of service (or your collective agreement's, if it's more favourable), plus your salary up to the last day, notice worked or paid, untaken leave and the bonuses in your contract. The site's calculator estimates the minimum payment.
Yes: a dismissal, whatever the reason, is an involuntary job loss. You must meet the other conditions, notably having worked long enough, and register with France Travail. Health cover portability, however, doesn't apply after gross misconduct.
12 months from notification of the dismissal, 5 years for harassment or discrimination. Unpaid wages, on the other hand, can be claimed within 3 years.
They are to be collected at the company: ask for them in writing, then send a claim by recorded delivery. If there's no answer, the employment tribunal can order them to be handed over from the conciliation hearing; you have 12 months from notification of the termination. Register with France Travail without waiting for them.
They must give you notice, over a period that depends on how long you've been there; if they don't, they owe you compensation. You're paid up to your last day plus your untaken leave, with your end-of-contract documents, but no redundancy payment.
