Reference salary, length of service in years and months, a quarter then a third of a month per year: the tool works out the statutory minimum payout and shows every step.

| Beyond 10 years: 33.3% of a month per year0 years × €2,000 ÷ 3 | €0 |
| Statutory redundancy pay | €5,000 |
Gross amount calculated by the site's code from the legal rules. Within ceilings set by law, this payout is exempt from income tax and social contributions; beyond them, the excess is taxed.
No payroll engine here: statutory redundancy pay follows a rule written in the law, which the site's code applies to the letter (service-public.gouv.fr, rule in force since 27 September 2017). The reference salary is the more favourable gross average between the last 12 months and the last 3 months. Length of service counts in whole years, with the complete months of the current year pro rata; it runs until the end of the notice period.
The amount is 25% of a month's reference salary per year up to 10 years, then 33.3% of a month per year beyond. The tool shows both bands separately so that you can check each line. Below 8 months of service nothing is owed; nor in the event of serious or gross misconduct.
So that two people get the same figure from the same gross pay, the site always calculates from the same baseline situation. Each line can be changed in the calculator's options where it matters.
A correct calculation for a typical situation is not your payslip. Here is what the tool does not know, so that you read the result as a reliable order of magnitude, not a promise.
For two reference salaries, the statutory minimum pay by length of service, gross, calculated by the site's code: 25% of a month per year up to 10 years, 33.3% beyond.
| Length of service | €2,000 gross a month | €3,000 gross a month | Months of salary |
|---|---|---|---|
| 1 year | €500 | €750 | 0.25 months |
| 2 years | €1,000 | €1,500 | 0.5 months |
| 5 years | €2,500 | €3,750 | 1.25 months |
| 8 years | €4,000 | €6,000 | 2 months |
| 10 years | €5,000 | €7,500 | 2.5 months |
| 12 years | €6,333 | €9,500 | 3.17 months |
| 15 years | €8,333 | €12,500 | 4.17 months |
| 20 years | €11,667 | €17,500 | 5.83 months |
The rule reads better in months of salary: each year of service up to 10 years is worth a quarter of a month, each following year a third of a month. After 10 years, you therefore get €5,000 for a reference salary of €2,000, the equivalent of 2.5 months of pay; after 20 years, the equivalent of 5.83 months. An incomplete year counts pro rata for complete months: each extra month adds a twelfth of the current band.
The reference salary counts everything subject to contributions: base pay, overtime, regular bonuses, benefits in kind. An annual or one-off bonus paid in the last three months counts for only a quarter in the three-month average; months of sick leave or short-time working are rebuilt at the usual salary, so that the absence does not lower the payout.
Redundancy pay is only one line of the final settlement. Added to it are pay for the days worked, pay in lieu of notice if the employer waives it, the pay for untaken holiday, and sometimes a pro-rata bonus, a time-savings account balance or a non-compete clause payment. The final settlement guide reviews each line, and the dismissal guide covers the procedure and deadlines.
A rupture conventionnelle gives the same floor, with no length-of-service condition: the rupture conventionnelle tool repeats the calculation and explains how to negotiate above it. To know what your next salary should be, the CV analysis estimates your market value.
You need 8 months of uninterrupted service with the same employer on the date the dismissal letter is sent (service-public.gouv.fr). With 7 months and €2,000 gross a month, statutory pay is €0; with 8 months, it rises to €333. Periods when the contract is suspended (non-work-related sick leave, unpaid leave) do not count towards service; the notice period, even if not worked, does.
It is the more favourable of two averages: the gross average of the 12 months before the dismissal, or that of the last 3 months, in which an annual bonus counts for only a quarter. With a three-month average of €2,200 against €2,000 over twelve, the three-month average is the basis: €5,500 for 10 years instead of €5,000.
The rate goes from 25% to 33.3% of a month's salary per year beyond 10 years. For a reference salary of €2,000, 10 years give €5,000; 12 years give €5,000 for the first ten years plus €1,333 for the next 2 years, i.e. €6,333.
Serious and gross misconduct remove the right to redundancy pay and to pay in lieu of notice. Pay for untaken holiday remains due whatever the reason, as does pay for the days worked. If you challenge the serious-misconduct classification before the employment tribunal and win, the statutory pay calculated here becomes due again.
Statutory or collectively agreed redundancy pay is exempt from income tax, and from social contributions up to ceilings set by law; only the part above those ceilings is taxed and subject to contributions. The ceilings change every year: check them on impots.gouv.fr or with URSSAF when you leave. The tool shows a gross amount, before those rules.
