A rupture conventionnelle (mutually agreed termination) payout cannot be lower than statutory redundancy pay, with no length-of-service condition: work out that floor, then negotiate above it.

Gross amount calculated by the site's code from the legal rules. Within ceilings set by law, this payout is exempt from income tax and social contributions; beyond them, the excess is taxed.
The specific rupture conventionnelle payout cannot be lower than statutory redundancy pay, nor than the collectively agreed pay when the collective agreement provides a higher one (service-public.gouv.fr). The tool therefore applies the legal rule: the more favourable reference salary between the average of the last 12 and the last 3 months, 25% of a month per year up to 10 years then 33.3%, complete months pro rata. Everything is calculated by the site's code, without a payroll engine.
Two differences from dismissal: no length-of-service condition (the floor is owed from the first month, pro rata) and no reason to justify, so no serious misconduct that would cancel the payout. The result is a minimum: the agreement you sign can set any amount above it.
So that two people get the same figure from the same gross pay, the site always calculates from the same baseline situation. Each line can be changed in the calculator's options where it matters.
A correct calculation for a typical situation is not your payslip. Here is what the tool does not know, so that you read the result as a reliable order of magnitude, not a promise.
For two reference salaries, the minimum rupture conventionnelle payout, gross, calculated by the site's code. Short service shows the absence of a condition: every complete month counts.
| Length of service | €2,000 gross a month | €3,000 gross a month |
|---|---|---|
| 6 months | €250 | €375 |
| 1 year | €500 | €750 |
| 2 years and 6 months | €1,250 | €1,875 |
| 5 years | €2,500 | €3,750 |
| 10 years | €5,000 | €7,500 |
| 15 years | €8,333 | €12,500 |
The rupture conventionnelle guide details each step, the form errors that get approval refused and what you can ask for on top of the payout.
The minimum calculated here is what the employer would have to pay if they dismissed you without misconduct. A rupture conventionnelle spares them the reason to prove, the notice period to pay and the risk of a lawsuit: those savings are your negotiating room. Three arguments carry weight: your length of service and what your collective agreement would have provided, the likely time before your next job, and the unemployment deferral that the part above the minimum triggers. Aim for a number of months of salary, and prepare what comes next: the unemployment simulator works out your benefit, its duration and the deferral, the CV analysis estimates your market value and the unemployment and salary guide explains what you will receive between two jobs.
To compare with a dismissal, the redundancy pay tool applies the 8-month condition and the serious-misconduct case; for the rest of the settlement, the holiday pay tool always comes on top.
Yes, and the payout is due from the first month, pro rata: the 8-month condition for dismissal does not apply (service-public.gouv.fr). With 6 months and €2,000 gross a month, the floor is €250. Nothing stops you negotiating more.
15 calendar days from the day after the agreement is signed, for you as for the employer, by recorded delivery or hand delivery against receipt (service-public.gouv.fr, rule in force since 25 June 2008). The request for approval can only be sent to the authorities once that period has elapsed.
Yes: an approved rupture conventionnelle entitles you to unemployment benefit, under the usual affiliation and job-search conditions. Three points to anticipate: a waiting period applies before the first payment, the part of the payout above the legal minimum lengthens that deferral, and for a contract ended since 1 September 2026, the benefit duration is capped at 456 days (15 months) before age 55 (unedic.org). The site's unemployment simulator puts a figure on the amount, the duration and those delays.
The floor of €5,000 for 10 years at €2,000 is a starting point, not an offer. Put a figure on what the employer saves compared with a dismissal (notice period, litigation risk, procedure), on what you lose (unemployment deferral, loss of income until the next job) and on what your collective agreement provides. Ask for an amount in months of salary, with one argument per month requested.
Like redundancy pay, it is exempt from income tax and contributions up to ceilings set by law, and taxed beyond them; the employer pays a specific contribution on its side. The ceilings depend on your pay and change every year: the tool gives a gross amount and does not calculate them.
A figure alone is not enough to negotiate. Upload your CV: the site estimates your market value from INSEE salary data, then helps you answer the salary expectations question.
