Procedure · Health and sick leave
48 hours: that is how long you have to send your sick note to your health insurance fund and tell your employer. Here is who gets which part of the form, what changed in 2025 and 2026 (secure form, prescription limits), the waiting days, sick pay and the rules on going out.
Nego follows the checked steps on this page, does the calculations with the site's tools and drafts your letters. It does not replace the administration: the procedure is completed on the official service.
The first time, the fund tells you about the delay and warns you. If you are late again within 2 years, your IJ can be halved between the prescription date and the date you sent it; since 1 January 2026, a note received after the end of the prescribed period may not be paid at all. No reduction applies if you can show you were in hospital or unable to send it in time.
It depends on what the doctor ticked: no outings, outings allowed with compulsory presence at home from 9am to 11am and 2pm to 4pm (every day), or free outings, which the doctor must justify medically. With free outings, tell your employer the times when a check visit is possible, otherwise they can suspend their top-up.
Yes, partly, if you have at least 1 year's service, sent your note within 48 hours and are treated in France or the European Economic Area (except home-based, seasonal, intermittent or temporary workers). Together with the IJ, you receive 90% of your gross pay for 30 to 90 days depending on your length of service, then two thirds for the same length of time, from the 8th day off. Your collective agreement may do better, up to your full salary.
Your fund, without warning: an administrative check (being at home at the set times) or a medical one (by the fund's medical adviser). Your employer too, if they pay you a top-up, through a check visit by an independent doctor. A decision by the fund can be challenged before its amicable appeals board (commission de recours amiable) within 2 months.
Yes, since 24 April 2024: leave for a non-work-related illness earns 2 working days (jours ouvrables) of paid leave per month, up to 24 days per reference period. Your employer must tell you your entitlement within a month of your return.
Yes, sickness IJ and the employer's top-up are taxable and are declared with your salary. IJ paid for a long-term illness (affection de longue durée) are tax-free.
Rules checked on 27 October 2026 against the sources above. This page explains the procedure; it replaces neither the administration nor legal advice.
